The term The Fizz Company or ‘us’ or ‘we’ refers to the owner of this website, and the term ‘you’ refers to the user or viewer of our website.
Our registered office is Parkhill Business Centre, Walton Road, Wetherby, LS22 5DZ.
Our company registration number is 4096032 – The Fizz Company is a subsidiary of Champagne Warehouse Ltd and trades under the Champagne Warehouse Ltd umbrella.
To purchase from The Fizz Company you agree to our terms and conditions.
1.1 The content of the pages of this website is for your general information and use only. At times we might have to change content without notice.
2. Age Restriction
2.1 We cannot and will not sell intoxicating substances to anyone who is not 18 years old or over. This is a legal requirement. By placing an order with The Fizz Company you are confirming that you are at least 18 years old. Anyone attempting to purchase alcohol under the age of 18 may be prosecuted.
2.2 Please note that the recipient of any gift from our range of products must be over 18 years old.
2.3 If our couriers are in any doubt about the age of the recipient they will request ID. If doubt still remains they are not permitted to leave the consignment.
3. Trading Hours/Office hours
3.1 Our business hours and office hours for accepting telephone calls are Monday to Friday, 9am until 5:30pm (Closed UK Bank Holidays). You can of course place an order via the website at any time, but please note orders will only be processed by The Fizz Company on the next working day, as defined above.
4. How to order
4.1 We are an internet trader therefore we encourage you to place orders through our online payment system (and it is simpler for you).
4.2 Any problems please call free of charge on 0800 313 4470 or fill in the contact form to contact us.
5.1 Delivery is only available within the UK mainland. Standard delivery is included in the price of cases. There is a delivery charge for single bottles and gifts. We will deliver within 5 working days of the order being placed. Please remember to indicate the delivery address if different from the ordering address.
5.2 Some postcodes may take longer than our stated 5 days for delivery, we will advise in these cases.
5.3 While we make every effort to ensure your order is delivered in the stated time frame we are not liable if we fail to do so in part or full due to circumstances beyond our control.
5.4 If you are not likely to be in when our courier delivers and you wish us to leave your consignment in a safe place, please advise us. However it is with regret that neither we nor our couriers can accept any responsibility for any subsequent loss or damage which occurs once the consignment has been left in the place designated by you.
6.1 We accept your order as an offer to purchase goods from us. The contract between us comes into existence once we accept your order and dispatch the goods to you.
6.2 We reserve the right to cancel orders we are unable to fulfill for any reason, but we will contact you to explain and you will receive a full refund if you have already paid.
6.3 The goods are ours until we receive payment in full. We do not normally dispatch until such time as payment is received in full.
6.4 If we are unable to fulfil your order due to stock unavailability we will do our best to contact you via the contact details you have left, either by email or telephone or both. For this reason please ensure the details you leave are accurate. If we are unable to contact you we reserve the right to substitute your order with a similar product. If we are not able to supply a particular item or are unable to supply a substitute we will not be liable to you except to ensure you are not charged for the item.
6.5 Please check your goods as soon as possible after delivery and notify us of any problems immediately but at the latest within 7 days of receiving the goods.
6.6 In the unlikely event of breakages, please retain the entire consignment as our carrier will need to collect the complete case including the damaged contents. If the entire contents are not returned we are unable to consider a refund.
7. Prices and Payment
7.1 All prices are quoted in pounds sterling and may be per bottle or per case (equivalent to 6x 75cl bottles), as marked. The prices include Duty and Value Added Tax, unless otherwise specified.
With the exception of our gift range and single bottles, standard delivery charges are included in the price.
7.2 We accept payment by debit and credit cards.
7.3 We reserve the right to change our prices as they are subject to currency and market fluctuations and also changes in VAT and duty. Please refer to our website for all current prices.
7.4 Discounts are offered on goods that have been previously advertised on our website for at least 28 days out of the previous 6 months at non discounted prices.
7.5 By giving us your credit card details you are confirming to us that you are the cardholder or have the cardholders permission to place an order.
8. Be a Taster
8.1 If your name is drawn we will contact you directly to ask whether you would like to taste a bottle of champagne for us.
8.2 A condition of accepting the offer is that you send us a comment about the champagne. We request that you taste the champagne within 2 weeks of receiving it and send us your thoughts about it within that time.
8.3 We request that you do not accept our offer of champagne if you will be unable to provide us with some comments.
8.4 We reserve the right to use your comments in the most appropriate way on our website.
9.1 Please do not be concerned about shopping on the web. We use a secure server with state-of-the-art encryption and secure sockets layer (SSL) technology for the transfer of credit card information. Additionally we have security measures in place to protect our customer database and access to this database is restricted internally.
9.2 For your protection and peace of mind we do not hold any records of your credit card details, our system will request these each time you place an order. This ensures that your card details are not misused.
9.3 It is your responsibility to protect any passwords from being disclosed to any third party.
10.1 You may cancel your order for any reason within 14 days from the day after you received your goods; provided all of the bottles are unopened and intact.
10.2 Please call us on 0800 313 4470 or contact us via e-mail (contact form) within 14 days of placing your order if you do wish to cancel.
10.3 Cancelled good must be returned to us within 14 days of cancellation.
10.4 We shall refund the price of the champagne and delivery charge (where applicable) within 14 days from the date we receive the goods back, provided we deem them to be of re-saleable standard.
10.5 It is your responsibility to take reasonable care of the goods until we collect them and you must make the goods available for collection.
11.1 In the unlikely event of all the bottles of champagne in a case being broken or spoiled when they are delivered, we will replace the case and for gifts and single bottles offer a replacement and refund the delivery charge. We will speak to you about what you prefer. Please also refer to section 6 of the Terms and Conditions.
11.2 If the wine is faulty and providing it is still within the recommended drinking date and has been stored in suitable conditions, we will arrange to replace the faulty bottle(s) or offer you a refund as appropriate. Please retain faulty bottles where possible as we reserve the right to collect them for inspection. We will speak to you about what you prefer. Please also refer to section 6 of the Terms and Conditions.
11.3 We may have to substitute your order with another product (due to unavailability) if you do not like the replacement we will pay for the goods to be returned to us (unopened bottles only).
12. Intellectual Property Rights
12.1 You agree and acknowledge that we own or are licensed to use all copyright database rights, trade marks and other intellectual property rights in and to all parts of this website, and to the business of The Fizz Company the structure, design and layout of the website, the styles of the champagnes and the electronic cellar. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
12.2 You are entitled to use our web site in accordance with these Terms & Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.
12.3 All persons, individual and corporate, are prohibited from providing hypertext or other links to the www.thefizzcompany.com web site, other than to our home page, from their own web site or from a third party’s web site, without our prior written consent.
12.4 Unauthorised use of this website may give rise to a claim for damages and/or criminal offence.
13. Warranties / limitation of liability
13.1 We warrant that the goods we deliver will be satisfactory quality and fit for purpose.
13.2 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies and errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
14. Please be aware
14.1 Alcohol should be consumed in moderation.
14.2 A case of champagne is heavy, if you are concerned about this please open the box where the courier has left it and remove a bottle or 2 at one time.
14.3 Champagnes and sparkling wines by nature can be volatile, please take care when opening. Always open the bottle away from yourself and other people. We cannot be held responsible for any injuries caused by opening a bottle.
14.4 Other than as stated elsewhere in these Terms & Conditions, all warranties, conditions, terms and undertakings, expressed or implied, whether by statute, common law, custom, trade usage, course of dealings or otherwise in respect of the goods and services provided by us hereunder are hereby excluded to the fullest extent permitted.
15. Data protection
15.1 By registering your details on our web site, you consent to us maintaining recording, holding and using personal data about you to process your orders to improve our service to you and inform you of promotions.
15.2 Your privacy is very important to us. Your personal details will only be passed to third parties where this is necessary for the purposes of processing your request, ie our couriers. From time to time The Fizz Company may send you details of products, unless you have informed us that you do not want your personal details to be used for this purpose by ticking the option at the checkout. Other than as stated in this policy, we will never wilfully disclose information about you to any third party without first receiving your permission.
16.1 From time to time this website may include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
